INTELLECTUAL PROPERTY AND CONTENT PROTECTION

1. Industrial and intellectual property in relation to logos, emblems, or any element incorporated in the design of this site belongs exclusively to Apptitudinal. The Apptitudinal logo is registered and protected by industrial property rights. The User acknowledges and accepts these rights. The elements of this website over which Apptitudinal does not have intellectual or industrial property rights are used with the corresponding permission.

2. The reproduction of all or part of the content of this website, in particular published employment offers, as well as its transmission or reproduction by any data retrieval system, in any form or by any means, is prohibited, unless prior authorization is granted in writing by Apptitudinal.

3. It is not allowed to circumvent the intellectual or industrial property rights of Apptitudinal over graphic elements protected by copyright, as well as to circumvent or attempt to circumvent the systems that protect or may form protection for the contents. Quotation is not permitted.

4. Any violation of the intellectual or industrial property rights of this website or Apptitudinal elements shall be subject to the appropriate legal measures to ensure their protection.

Responsibility for the content of the Website 

The data, texts, information, graphics or links published on the website are compiled for merely informative purposes for all those having an interest in them, and their access does not generate a commercial, contractual or professional relationship between the User and the company. In the event of a discrepancy between the information contained on the website and that contained on paper, the latter shall prevail. The company reserves the right to modify the contents of the web domain without prior notice. 

The external links contained in this Website lead to sites managed by third parties. 

Apptitudinal is not responsible for the content or the status of said sites. The use of external links does not imply that Apptitudinal recommends or approves the contents of the landing pages.

Confidentiality 

APPTITUDINAL undertakes to maintain complete confidentiality, both during the period of validity of the commercial relationship with its clients and candidates and once that relationship has ended, with respect to all the information obtained directly or indirectly related to the services provided, responding for any disclosure of said information to third parties unless expressly authorized in writing, in the event of which it is obliged to compensate the other party for any damages that may arise from the disclosure of said information. 

For the purposes of said responsibility towards third parties, confidential information shall be considered to be any information related to commercial matters, legal documents, technology, methodologies, technical manuals, technical information, processes, products, services, marketing techniques, sales strategies, pricing policies, financial offers, missions, personal data related to employees, resumes, candidates and/or clients, facilities and installations, as well as any other information processed during the mission which is linked to clients or candidates or any of their resources. 

The parties mutually agree to protect the information provided by the other party from any form of unauthorized disclosure, provided that said information has been clearly identified as confidential, in writing. The parties undertake to apply the same diligence in protecting the information of the other party as they would apply to protecting their own confidential information during the entire term of the commercial relationship. 

The parties may not use the confidential information of the other party to which they have access under this clause for purposes other than those initially stated; the transfer of confidential information to third parties being expressly prohibited. 

On expiration of the commercial relationship the contracting parties are reciprocally obligated to return all documentation or material that either of them may have received, without the need for prior request. 

If it is necessary for APPTITUDINAL to access the personal data of the other party for the execution of the services agreed between the parties, the latter authorizes this by accepting the present clause. Access to data by APPTITUDINAL shall be made in the capacity of data processor under the provisions of current regulations relating to the protection of personal data and access to data by third parties. 

In the foregoing case APPTITUDINAL undertakes and is obliged in accordance with the provisions of Article 28 of General European Data Protection Regulation 2016/679 to: 

a) process personal data solely by following the documented instructions of the controller and those contained in this contract, including with regard to the transfer of personal data to a third country or an international organization, unless it is obliged to do so under national law or the laws of the Member States which apply to the data processor; in this case, the data processor shall inform the controller of this legal requirement prior to processing the data, unless said law prohibits this for reasons of public interest; 

b) ensure that the persons authorized to process personal data have undertaken to respect confidentiality, or are subject to an obligation of confidentiality of a statutory nature; 

c) take all the necessary security measures in handling and access to the data;  

d) respect established conditions when using the services of a third party data processor; 

e) assist the data controller, taking into account the nature of the processing, through appropriate technical and organizational measures, whenever possible, so that they may comply with their obligation to respond to requests that have as their object the exercise of the rights of the interested party; 

f) assist the data controller in ensuring compliance with obligations relating to data security and the management and communication of data security violations; 

g) at the discretion of the data controller, delete or return all personal data once the provision of processing services has ended, and delete any copies which exist unless the conservation of personal data is required;  

h) make all the information necessary to demonstrate compliance with the above measures available to the data controller, as well as allowing and contributing to the performance of audits, including inspections, by the data controller or another auditor authorized by said data controller. 

Without prejudice to the foregoing paragraph, APPTITUDINAL shall maintain a copy of the data (in any medium or document), duly protected, when necessary for reasons of professional responsibility and/or based on legal, fiscal and/or administrative obligations, being obliged to destroy said data once the reason that justified its maintenance no longer prevails. 

The client, employee or candidate is hereby informed and expressly authorizes APPTITUDINAL to: 

communicate data to administrative and/or judicial bodies, as well as to other third parties, provided that such communications are legally necessary for the provision of services; 

permit access to data to those companies that provide support, subcontracting and technical services to APPTITUDINAL, to the extent that such access is necessary for the execution of the services in the opinion of APPTITUDINAL.  


Regulations and Jurisdiction 

All points in the present Conditions of Use of the Website are governed by Spanish law. The original written language and interpretation of this legal notice is Spanish.
